Indemnity

Medical indemnity cover or indemnity insurance is a liability insurance product for businesses and individual practitioners who provide medical advice or expertise to third parties. Other names for this are professional liability insurance or errors and omissions insurance. This is a mandatory requirement that is designed to protect the insured practitioner if they are accused of negligence, malpractice or a breach of clinical or professional care standards. It is important that the practitioner has an adequate indemnity limit for their circumstances and this must be in place before they start to practise.

There are two forms of indemnity cover, discretionary and contractual. Discretionary indemnity is usually provided by one of the medical defence organisations on a membership basis. The practitioner applies for membership, is accepted and pays a subscription. There is no limit to the indemnity offered or the expenses that can be paid, but payment of any claim is discretionary and can be refused. Contractual indemnity is offered by a commercial insurance company. The practitioner applies for insurance via a proposal form, pays a premium when accepted and then has clear terms and conditions detailing exactly what is and isn't covered, including the maximum indemnity limit.
